Both the crown prosecution service (CPS) and the Police play a key role in criminal court proceedings. As you will see below, the CPS drew significant unwanted attention and prejudice towards Jemma with their opening statement. The QC dramatised his statement and even broke with court convention by using misleading statements. Unfortunately, this set the tone for some of the sensationalist media coverage that ensued during the case.
The police chose to use a recently accused rapist and a cousin who confessed to taking sexual advantage, as witnesses against Jemma. This act was not only morally wrong, but indicated how desperate the prosecution were to force a conviction. Witnesses are meant to be unbiased and not be providing “evidence” in order to save their own face.
